Rob, I am in full agreement that data access/control, and national 
policies, are both beyond the rds-pdp-wg remit. All I have cautioned 
against is letting it repeatedly creep into data element discussions 
within the rds-pdp-wg, and have suggested that the multi-jurisdictional 
issue for data, be it in distributed private networks or data (rds or 
other) stored in the more generic "cloud", is a pending global Internet 
policy issue in which ICANN and its constituencies are stakeholders, and 
that they/we should think about how, and where, those policy issues 
should be addressed.

Also, I like the suggestion that this is an issue and policy area where 
ICANN and its constituencies should be telling GAC that part of what GAC 
should do is take the multi-jurisdictional data issue home and figure 
out how countries are going to cooperate to deal with it. I may be wrong 
but I see the way forward as something that is multilateral, much in the 
vein of the Law of the Sea. Where those deliberations should take place, 
in what venue and within what process, are issues to be addressed. As 
several of our colleagues are quick to point out, there are growing 
areas of Internet policy that are outside ICANN's remit, but where they 
impact ICANN's operations and policies.
