Here is the letter, let me know if you have any questions as to why I assembled it in this way:


Dear Vicky and Peter:

I am writing to you as Co-Chair of the ICANN policy working group that is reviewing the RPM mechanisms and, in particular, as Chair of a sub-group that is seeking data to support the work of the RPM review.

It will not come as a surprise that we recognize that the Trademark Clearinghouse might have access to meaningful data that is relatively easy to obtain so long as it has not been determined to be confidential.

ICANN staff members have been able to provide data that has been published through presentations by you and others at ICANN meetings and other venues. But that data covers only certain periods of time that were addressed by those presentations.

We are aware that the Clearinghouse provides regular data reports to ICANN. We are writing to request that the TMCH make those reports available to our working group (with confidential data redacted if need be). The data can be made available in any way convenient to you. We would rather see the reports rather than have you refine or synthesize the data in any way.

It might seem strange that we are requesting access to reports without knowing the specific data in them or without providing you with specific data sets that would help answer our charter questions directly. Our thinking is that this data is rather easily obtained since it has already be collected and synthesized by you and is likely to be helpful in answering several of our questions. Therefore, we thought to ask for this "low hanging fruit" before making a deeper dive into specific data that might be harder to obtain. In the end, we think access to the reports will reduce our data requests afterwards, lessen the amount of work overall, and hasten the conclusion of our work.

Please let me know how you view this request, any terms or qualifications to the release of the reports if that can be done, and any questions you might have. Of course, the entire ICANN community wants us to get on with this work so please respond in some way as quickly as possible.
