Dear all,

I too, like Paul K., have reservations about "expanding the reach" of TM
holders. With the exception of commonly abused terms perhaps, it is
difficult for me to fathom whether Greg S' proposal addendum, with or
without the additions suggested by Jonathan A. and Brian W., should they be
taken up, would result in fairness to as opposed to over-reaching in favour
of TM holders.

While we still have no conclusive data to support a conclusion that many
potential registrations are abandoned as a result of Claims notices being
received, I think it would still be imperative to ensure that the language
and messaging of such notices are simple and clear (as Paul K. puts it) in
explaining the reason for the trigger / receipt of such a notice and which
does not suggest that a relevant TM holder has any exclusive rights to any
non-exact match variants.  It seems to me that limiting (or not) the
triggering of a claims notice is something entirely within the control of
ICANN / TMCH and I think more emphasis should be placed towards not
discouraging potential good-faith registration, since I imagine bad-faith
actors would ignore any amount of claims notices anyway.

Also, do we have any concrete or anecdotal data which suggests that the
TM+50 is unpopular to TM holders?  If so, is it simply because of a cost
factor? Apologies if I have missed this, and would be grateful to be
pointed to the source of such data, if any.

Leaving aside the technicalities and cost of implementing any proposed
expansion, I look forward to paying greater attention to the upcoming
Claims Notices review.
