Hello Greg and everyone,

The form and motion as you see it was submitted to the Council – as you may know, it is not uncommon for documents to be updated after the Council’s document deadline but before the Council meeting. We thought it ought to be submitted in the form that would be sent to the Working Group, since you have not had a chance to see the revisions that were made following the Working Group call on Wednesday. Rest assured that we will be requesting that a clean version be voted on by the Council, assuming there are no further edits or corrections.

As to the language to be added back in, that text was in the previous version (i.e. the one discussed on the Wednesday call). Staff had thought that only the portion of the text specifically referring to gaming was what was to be retained and moved, which is what you see in the version that has been circulated. We have since been requested to retain and move the full text to better reflect the group’s understanding.

It looks like there's a mistake here.  The copy of the Metrics Request Form attached to this email includes a number of marginal comments.  Was this submitted to the GNSO Council this way?  If so, a clean copy should sent to Heather so that it can be substituted for this marked-up version ASAP.  This is particularly important since the Motion states that Council is voting on the final text.

Also, I'm unclear why "Staff will also be adding back, at co-chair Kathy Kleiman’s request, the following text that was in the original suggestion on gaming (which has now been moved, per Working Group agreement, to be part of the general research tasks listed as #7 from its previous standalone entry): “… including those describing the registration of the word “the” and single letter marks, and any investigation/reporting of issues/concerns/problems with TM Claims notices and abandonment.""

According to the marginal comments in the draft Metrics Request Form the text above is being tacked on to "additional text added as per agreement during the 6 September WG call. This is meant to replace the alternative text suggested by Kathy: "SUBTEAM SUGGESTION: Find articles that discuss “gaming” of the Sunrise Period, including those describing the registration of the word “the” and single letter marks, and any investigation/reporting of issues/concerns/problems with TM Claims notices and abandonment."

Looking only at the language quoted above, it appears that a WG agreement on language is being overridden by a single co-Chair.  I'm sure that this would not be allowed to happen, so I must be missing something.  I would appreciate some clarification.

For your reference, here are the action items from our last call, all of which have been completed:

  1.  Co-Chairs and staff to update and finalize data request to the GNSO Council
  2.  Staff to circulate links to the recording and transcripts of the joint call between the leadership teams of the RPMs Review PDP Working Group, the new gTLD Subsequent Procedures PDP Working Group and the GNSO Council
  3.  Staff to remove the prioritization columns from the Google Doc when it is submitted as part of the data request
  4.  Staff to move the question about translating the Trademark Claims Notice from the survey of registrants and potential registrants to the survey of registrars
  5.  Staff to add Sunrise gaming to the task of gathering third-party sources and delete it as a standalone task
  6.  Staff to replace the words “scope and cost” with “feasibility” in the task regarding development of a system to handle non-exact matches
  7.  Staff to correct reference under anonymized data from Deloitte from Sunrise to TMCH registration, and clarify that the data should include both undisputed domains as well as domains in dispute
  8.  Staff to clarify that data collection suggestions on URS also include UDRP disputes

The meeting notes will be uploaded to the Working Group wiki page for this meeting shortly.
