[IOT] IOT meeting tomorrow (Thursday, May 10) at 19:00 UTC

Dear members of the IRP IOT:



First - we have a meeting set for this Thursday (tomorrow) at 19:00 UTC. I was considering cancelation while we work on list but in light of Sam Eisner's email<https://mm.icann.org/pipermail/iot/2018-May/000390.html> of yesterday evening let's keep this meeting - a good chance to discuss Sam's proposal. See Agenda below.



Second, based on our last call (May 3rd), it appears we have a way to move forward with the draft supplementary procedures.



My understanding is based on Sam's comments on the last call regarding the repose issue going to public comment in light of the majority support for the position articulated by Malcolm.



 The process for going forward would be along these lines (as we may tailor on the call tomorrow in light of Sam's proposal of yesterday):



1.      We would seek public comment on the time-for-filing issue using the draft supplementary rule 4 verbiage provided by Malcolm - ICANN envisions submitting a minority statement on this. I could do a draft on the submission for public comment. The sooner we get this out for comment the better, in my opinion. [Malcolm's proposed rule 4 is set forth below.]



2.      We would in meantime on list attempt to solve the types of hearing rule and the elements language I proposed (with an addition on elements as proposed by Kavouss - I would be responsible for getting these on list in the coming days). These are not significant enough to warrant public comment, in my view. If anyone disagrees please do so quickly.



3.      We would clean-up the IRP IOT Report on Public Comments document that we have been reviewing (see my email<https://mm.icann.org/pipermail/iot/2018-February/000367.html> of Feb, 20, 2018) or use Sam's proposal in order get Sidley's input to make sure we accurately reflect this state of affairs (I do not envision us needing Sidley's help on the time-for-filing issue or the other two mentioned above, types of hearings and elements).



4.      We can continue work on list following the call tomorrow. We can also schedule a meeting to address outstanding issues on May 22 (Tuesday) or 24 (Thursday) if available. Or Bernie can help us find a suitable date. (I am away on business Tuesday May 15 through Friday May 18).

         Here is Malcolm's language:



         Proposed Rule 4. Time for Filing:



         An INDEPENDENT REVIEW is commenced when CLAIMANT files a written statement of a DISPUTE. A CLAIMANT shall file a written statement of a DISPUTE with the ICDR no more than 120 days after a CLAIMANT becomes aware, or ought reasonably to have been aware, of the material affect of the action or inaction giving rise to the DISPUTE.



         In order for an IRP to be deemed to have been timely filed, all fees must be paid to the ICDR within three business days (as measured by the ICDR) of the filing of the request with the ICDR.
