Responding to your points:

(1) Council will have a joint session with the GAC on Tuesday at ICANN77.  I consider it likely the March 23 letter will come up during that meeting.  Did I miss a previous  acknowledgment from Council to the GAC re this letter?  (Leadership may have sent one and I could have failed to log it.)

The joint GAC and GNSO leaderships had a meeting yesterday to discuss our bilateral agenda. The March 23 letter and the GAC questions were acknowledged by us on 9 May (https://gnso.icann.org/sites/default/files/policy/2023/correspondence/ducos-to-caballero-09may23-en.pdf) and we did agree yesterday to discuss them during our meeting. The GAC Leadership fully understands that these questions were not forgotten, but that given our short deadlines, we had to focus first on our defining the remaining issues and potential paths to resolution with the Board.
Having followed to work of our small team, I get a sense that we found answers to most of the GAC’s points and we should be able to at the very least engage on them on these during our bilateral. In any case the GAC Leadership does not expect final answers by ICANN77, and was rather interested in insuring their points were in our minds when reviewing the 38 outstanding recommendations, to ensure no remedy we would agree with the Board would go fundamentally against the GAC’s view.
In any case, Leadership just had a call to prepare our agenda for next Monday’s call (5 June), and we did earmark time to go through these and verify we are in agreement on how to engage the GAC on them during our bilateral.


(2) At Seb's request, Susan and I will soon be bringing a discussion item before Council from the Sub Pro IRT in relation to the chartering of the SPIRT (Standing Predictability Implementation Review Team)  which is referenced at the top of page 3 of the attached GAC letter to Council.

For full transparency: during the last SubPro IRT meeting the topic of the SPIRT was discussed and it was agreed that the IRT would indeed need Council’s input on chartering. Normally, in these circumstance the IRT leadership turns to the GNSO Council Liaison to ensure the IRT requests are passed onto Council.
Following our last Council meeting and the suggestion that we send 2 Liaisons to the SubPro IRT (pending non-objection by Councillors, a reminder for which remains to be sent on the list), I invited the IRT Leadership to address the matter with Anne and Susan both, and to continue doing so as an interim solution, until we are able to formally designate one or more Council Liaisons.
I hope we are able to resolve the matter of designating a Liaison promptly, as this IRT will be sure to bring significant amount of back and forth with Council; even if I understand that the specific topic of the SPIRT charter is not yet one of highest urgency.

Item 3: COUNCIL DISCUSSION - SubPro - Progress Update on Recommendations Marked as Pending  (100 minutes)
During its informal session at ICANN76 and the subsequent Council meeting, the Council discussed and agreed<https://gnso.icann.org/sites/default/files/policy/2023/minutes/minutes-gnso-council-15mar23-en.pdf> to task a small team of interested councilors to review the recommendations that the Board placed in a pending status and suggest to the full Council how the underlying concerns that caused the pending status can be best addressed (i.e., a limited triage exercise). Interested Councilors were asked to volunteer for the Small Team by 15 March 2023.
Since ICANN76, the Council SubPro Small Team has met several times and has completed an initial run through of the issues chart, with Board member input on why the Board placed specific recommendations into a pending status. The Council discussed the main output of that triage effort, the proposed paths forward for each pending recommendation, during an Extraordinary Meeting on 4 May. During that meeting, the Council agreed to further task the small team with taking interim steps (e.g., provision is clarifying information, developing speaking points) in order to support the Council’s dialogue with the ICANN Board on 22 May<https://community.icann.org/pages/viewpage.action?pageId=240617931>. The Council debriefed after the dialogue with the ICANN Board and discussed next steps. The small team has continued to consider what the “landing spots” are for each recommendation, though the Council and small team are still awaiting input from the Board on where they believe the “landing spots” are; ideally, there will be mutual agreement in as many places as possible, which among other things, helps facilitate the development of a more accurate work plan and timeline (i.e., the key deliverable for ICANN77 in respect of the pending recommendations).
Here, the Council will discuss the progress the small team has continued to make, discuss additional work that may be needed as a result of where certain recommendations may land, as well as discuss how best to use the time allotted for the pre-ICANN77 all day Council sessions.
