Hi John, you are accidentally misinterpreting my words and the document:

On Consent: "It seems that in an ICANN environment, the *data processing 
based on consent is practically impossible* as in case of non-consent 
the same service would not be provided to the data subject, which means 
that the *consent can never be freely (and unconditionally) given*."

Pretty clear to me...

As for privacy by default, I never said either. I just summarized that 
it was a condsideration raised in the document.
