Thank you to everyone who raised questions regarding the Nominating Committee Delegate.  As you can see, I went to ICANN to clarify that point.  Below is the clarification from Teresa Swinehart (thank you Teresa).

I stand corrected regarding whether or not the delegate can work for a registrar.  I would urge you to consider nominating someone who will clearly "be independent and not accountable, or beholden, to the constituency that selects them, or to any person, employer, or organization," while also having a good understanding of the ICANN dynamics and the registrar market.

Remember that we must choose someone by May 11, so nominations must be made this week!

Please find the following in response to your question on what is meant by
the criterion # 4. 

ICANN expects the NomCom delegates to be independent and not accountable, or
beholden, to the constituency that selects them, or to any person, employer,
or organization. This was made clear to all the members of the 2003 NomCom
members, but given that it was the inaugural NomCom, the constituencies
themselves may not have understood this point.

Criterion 4 addresses how the person selected is expected to behave, not who
employs him/her or for whom he/she consults. Those selected by NomCom are
selected in a NomCom group decision, through the development of consensus by
delegates from all constituencies.

Those involved in selecting the delegate may judge that the only way for a
delegate to achieve this independence is by restricting
employment/consultant status, but that restriction is not required by ICANN.

The NomCom takes very seriously its responsibilities to require NomCom
members to disclose actual and perceived conflicts of interest. See the
posted Code of Ethics, and the Charge to the Subcommittee on Conflicts of
Interest. http://www.icann.org/committees/nom-comm.htm     The 2003 NomCom
members disclosed their affiliations and disclosed actual or potentially
perceived conflicts of interest to the Chair and Subcommittee on Conflicts
of Interest. The Subcommittee determined how any disclosed conflicts or
potential conflicts would be handled, including recusal from participation
in discussion and voting. I hope this is helpful.
