Dear Rafik, Paul and all Councilors,

Please find attached an updated draft RPM Charter Addendum for your review, in both “redlined” and clean formats. We have tried to address the concerns raised by Rafik in a number of places: e.g. adding a step where the full RPM Working Group is able to provide input to the IGO Work Track prior to any publication of initial recommendations for public comment and clarifying that the Work Track chair must provide regular updates not just to the GNSO Council but also to the RPM Working Group.

In view of the upcoming Montreal meeting, please note that Keith has requested that staff send this new version to the GAC leadership, to ensure that the GAC and IGOs have the opportunity to provide feedback before the Council finalizes and votes on the document.

Hi Paul,

thanks for the clarification,
to avoid any disturbance, I think we can add a deadline for the RPM WG to review and give input but it is not to necessarily get an approval (no more than X weeks for example) after that RPM WG can still submit at the public comments consultation like any group . I guess one way to alleviate any risk of delay is that the track should keep reasonably the RPM WG up to date about the deliberations so recommendations won't come as surprise.

I guess I read “public comment” to include all of the public which by its nature brings in the members of the full RPM WG.  My concern about baking in a step of formally presenting a draft report to the WG for comment is that will cause a 3-6 month delay and could disrupt the workflow of what will very likely be Phase 2 by then.  Are you envisioning a formal delivery and wait for comments before the initial report back be published, or more of an FYI/heads up with no delay baked in?

Thanks for the new version.
I am sharing some comments:

  *   under section 4 ,"(i) The IGO Work Track must publish its initial recommendations for public comment prior to delivering its final recommendations to the full RPM Working Group;", it seems that RPM WG won't get the initial report and only have a say for final recommendations. When reading the points iv to vii, the RPM WG doesn't seems be able to have any substantial influence. I am not sure that aligned with how WT5 is functioning or supposed to.
  *   for reporting, I think the IGO track chair is accountable to GNSO council regarding the reporting. They can interact with other SO/AC and their leadership if necessary but we need to be clear to whom they are are supposed to report and respond in first place. this track is not a CCWG. I ask to remove that part.
  *   for membership, it seems with the current wording "Up to 2 Members from each interested SO and AC. Up to 2 Members appointed by and representing IGOs." that GAC will be represented twice. By the recurring engagement with GAC, we can understand this narrow topic interest mainly IGO who are members/observers in the GAC. I suggest that GAC only get to appoint up to 2 reps and from IGO.

Hi all,

Following up our Council discussion last Thursday, if anyone has further comments or suggested edits to the draft RPM Charter addendum, please send them to the list by 22:00 UTC on Tuesday, 1 October.

To summarize comments to date, during the Council call, we agreed to remove or significantly amend the paragraph referencing Recs 1-4, and to include language suggested by Maxim related to expertise of participants.

As discussed, this draft has been available for review and comment since 9 September, and we need to move it forward. Our target is to have this addendum ready for Council approval in Montreal, so your timely attention is appreciated.

Once we have a stable draft, I will share it with GAC leadership and IGOs to seek preliminary feedback prior to our 24 October Council meeting.

On behalf of Paul McGrady, who led the small team effort along with Martin Silva Valent and Elsa Saad to develop a draft amendment to the current Review of All Rights Protection Mechanisms (RPMs) PDP Working Group Charter, please find attached a proposed draft Addendum to the RPM Charter for your review and discussion on the upcoming Council call. The document has also been reviewed by Petter Rindforth, the Chair of the IGO-INGO Curative Rights PDP Working Group. You will see some comments and yellow-highlighted text of some provisions that the Council may wish to discuss.

Based on the small team’s understanding and the informal discussion that was held in Marrakech between several GNSO Councilors, GAC and IGO representatives, this draft document will also be sent to GAC leadership for their feedback, with the expectation that a final version can be voted on by the GNSO Council by/in Montreal.
