Please see attached the proposed revised Rule 3 text - highlighted in yellow for visibility:

  *   Defines "Administrator" in order to standardise
  *   Subsection 2 - limits the reference to lack of capacity, without expanding on the types of lack of capacity envisaged in the Bylaws
  *   Subsection 3 (a) - we had discussed deleting this and simply falling back on the process based on that of the ICDR set out in the subsequent subsections.  Much of the concern with (a), however, appeared to be around the Standing Panel chair imposing their own will on the parties.  Rather than simply deleting therefore I have suggested as a compromise that the parties seek to agree a process that allows them to select those Standing Panel members who are available.  If they cannot agree, then the process in (b) - (e) applies.  Having the parties agree their own process is itself in line with the ICDR procedure.  If there is not support for this compromise, however, we can simply delete it and retain the remaining subparagraphs.
