Question about receiving confirmation from the Registrant:

For the .COM and .NET Registries, how do we acquire the authentic e-mail
address for the Registrant?  It is in very few, in any, Registrar Whois
outputs.  In fact, based on the discussions that I have seen surrounding
Registrars migration to EPP for the .ORG Registry, some Registrars may not
store e-mail addresses for Registrants.  I am most concerned about the
availability of this information from a certain market leader whose
information may be incomplete due to the fact that the data was not
requested in past years.

Correct.  The gaining registrar however MUST receive confirmation from
the registrant prior to sending a transfer command to the registry.

A dispute resolution process has been established to deal with
situations where a losing registrars believes that a gaining registrar
has not obtained the appropriate authorisation.
